Constitutional Court Restores Limitation of Legal Proceedings Against BCP Crimes After 1944

The Constitutional Court has annulled the abolition of the limitation of legal proceedings against crimes committed by high-ranking members of the Bulgarian Communist Party between 1944 and 1989, reported Praven Svyat (Legal World).

With the decision today, adopted with 11 votes “for” and 1 “against” (cast by Filip Dimitrov), the regulations of the Penal Code adopted by Parliament in September 2015 were declared unconstitutional.

These regulations decreed penal responsibility for crimes committed after September 9, 1944 in spite of the expiry of the limitation of legal proceedings i.e. the limitation of legal proceedings was to be abolished.

The amendments were proposed by GERB and the Reformist Bloc and adopted with 111 votes “for”, 30 “against” and 7 abstentions.
