Bulgarian Government To Ensure Better Protection for Employees Sent to EU

The Bulgarian government has approved amendments to the Labour Code which ensure better protection for Bulgarian workers sent on working trips in the EU, reported the press centre of the Council of Ministers.

The draft bill introduces requirements under European directives which settle the cases of sending employees on working trips from one EU member-state to another, to a member-state of the European Economic Area or to the Swiss Confederation.

The amendments to the Labour Code introduce a requirement for employers to secure for employees sent on working trips at least the minimum work conditions set for employees doing the same or similar job in the receiving country.

The requirements concern the maximum duration of the work stay and the minimum length of leave, the minimum number of days on paid leave, the minimum wage, including overtime.

The draft bill envisages regulations which allow employees sent on working trips to Bulgaria to sue their employer in case of damages suffered due to non-compliance with minimum work conditions stipulated in the Labour Code.

Employees suing their employer for non-compliance with minimum working conditions will be protected from any unfavourable treatment on these grounds by their employer.
