Bulgarian Court Dismisses ID Documents Collective Claim

Sofia City Court has refused to sit on the collective claim against the Bulgarian Interior Ministry over the bad organization for the issuing of the new identity documents.

The collective civil action has been submitted by the Bulgarian Association "Justice Civil Initiative."

The association has demanded that the ministry should pay BGN 1000 as a partial compensation from the total requested amount of BGN 50 M for causing non-pecuniary damages to people who have submitted requests for new documents.

According to the judge, there was no collective interest, which would allow the submitting of a collective claim on behalf of all victims.

He added that there might have been a personal interest affected, which would mean that anyone who is dissatisfied with the organization for the issuing of the new identity documents, should file a single claim.

Participants in the association have stated that the judge's hypothesis that there has been a personal interest affected "only causes sad smiles at everyone who has ever had a cursory contact with the Bulgarian judiciary."

"Justice Civil Initiative" has also submitted another claim, contesting the fees for issuing new identity documents. According to the association, they have not been defined in compliance with the expenses for the service.

The Supreme Administrative Court will sit on this case on January 12, 2011.
