Top Bulgarian Judge Calls for Sound Legal Thinking

Being detained or released on bail when sued does not have implications for one's guilt, stated the president of the Bulgarian Supreme Court of Cassation Lazar Gruev.

“Society must know that neither release on bail means innocent, nor being detained means guilty. The question about the guilt of the accused is decided by an enforced verdict,” stated Gruev.

The high judge elaborated that measures such as custody and bail, referred to in Bulgarian law as “measures for non-diversion,” have as their goal coercion to abide by the criminal procedure on the part of persons charged. Thus they have nothing to do with the final verdict of the court.

Gruev's call for level-headedness and explication on fundamental legal concepts was provoked by the ongoing conflict between executive and judiciary in Bulgaria, which was sparkled anew when the Sofia Court of Appeals released on bail Tuesday suspects from the high-profile “Killers” and “All Trumps” trials. This provoked the ire of PM Boyko Borisov and Minister of Interior Tsvetan Tsvetanov, who saw the actions of the court as incompetent and sabotaging the honest efforts of Bulgarian police.
