Bulgaria to Have Small Cyber Crimes Fighting Agency

Bulgaria may create an agency fighting small cyber crimes like illegal distribution of music, video files, and software over the Internet.
The idea has come from the head of the “Computer Crimes” department in the Interior Ministry, Yavor Kolev, speaking at an international conference on copy rights, organized by the Bulgarian Culture Ministry.
In his words, in order the work of his department to be improved, there need to be made some amendment in the legislation.
If such an agency is created, the professionals working in the “Computer Crimes” department will be able to investigate more serious cases of pirate files distribution, Kolev said.
“This is just an idea for those who create laws. Just to give the agency the legislation basis to exist. And to impose administrative sanctions to those users who dare to download or upload illegal files. Main Directorate for Fighting Organized Crime (GDBOP) should not deal with this matter”, Kolev explained.
According to him, the work efficiency in his sector can be improved by making some legislation changes. He gave as an example a server confiscated in the beginning of 2008. The case against its owner has not be filed in the court because of th slow procedures.
“Our Penalty Code rules that every single video or music file must be identified – the holder of the copy right must be clarified. Finaly, these people by a new server and start working again, because they are sure that the procedure may take even 25 years. My question is, why don't we check five files, and if they are illegal the owner to receive a suspended sentence. If he is cought again with the same violations, the sentence will not be a suspended one”, Kolev said.
He also addressed all those dealing with illegal files: “If there are media here, please tell these boys that their business in doomed”.
