Bulgaria Cabinet Attacks Amnesty Act as Anti-Constitutional

The Bulgarian cabinet is going to submit next week with the Constitutional Court a demand to declare the Amnesty Act anti-constitutional.

The information was revealed Wednesday by Prime Minister, Boyko Borisov, during an interview for the morning block of the TV channel bTV.

The Act was passed in March 2009 and came into effect on April 22. It gives amnesty to all those who by July 1, 2008, were charged with reckless crimes punishable by up to 5 years behind bars. The crimes include reckless malfeasance in office - the Penalty Code text that was the most applicable to charge people, who have used their office position to cover fraud with budget or European funds.

"They sign contracts for the purchase of aircraft and then the Minister whose signature is on the contract cannot be tried because he has committed reckless malfeasance. At the end, the Act allows for current ministers to be charged, but not former ones," Borisov said in the interview.

The PM reiterated several times that the "Bulgarian people had yet to realize the extend of the crimes committed by the former cabinet, and he, himself, had a hard time believing what legacy he had inherited."
