Sofia Mayor Fined BGN 31 500 over Failure to Implement Court Decision

The Administrative Court Sofia-City has imposed Sofia Mayor Yordanka Fandakova a fine of BGN 31 500 for repeat failure to implement a court decision on a case concerning implied decision refusing access to public information.

Fandakova refused to provide information under the Access to Public Information Act about the detailed development plan of the area “Grobishten park – B” (Cemetery Park).

The case was initiated in 2011, according to reports of the BGNES news agency.

Under Bulgarian legislation, the municipality is obliged to reply in writing, stating its reasons, while in this case there was no reply.

Two fines have already been imposed over the case, one amounting to BGN 200 and the other one to BGN 5500.

Despite that, the inaction of the Sofia Mayor continued and no decision was issued on the request for information.

The Administrative Court Sofia-City declared that Fandakova had presented no evidence of the implementation of the court decision by the beginning of October 2014 and therefore had to pay the fine.
